“Cleanny Property Services Ltd” – refers to Cleanny Property Services Ltd and any franchisees operating under a franchisee agreement.
“Cleaner” – denotes the individual or firm responsible for conducting cleaning services on behalf of Cleanny Property Services Ltd.
“Client” – signifies the person, entity, or corporation, including any subsidiaries or associated companies defined by the Companies Act 1985, to whom Cleanny Property Services Ltd provides cleaning services.
“Service” – pertains to the cleaning services executed on behalf of Cleanny Property Services Ltd.
“Cleaning Visit” – signifies the visit made by a Cleaner to the Client’s service address for the purpose of performing the Service.
2.1. These Terms and Conditions establish a binding contract between Cleanny Property Services Ltd and The Client.
2.2. The Client acknowledges that the utilization of Cleanny Property Services Ltd’s services, including the placement of service orders via telephone, email, or website forms, constitutes acceptance of these Terms and Conditions.
2.3. These Terms and Conditions take precedence over any other terms of business or purchase conditions presented by The Client unless otherwise mutually agreed upon in writing.
2.4. No alterations or variations to these Terms and Conditions will be deemed valid unless officially approved in writing by a director of Cleanny Property Services Ltd.
2.5. Cleanny Property Services Ltd adheres to a minimum charge of 2 hours per cleaning visit.
3.1. All work conducted by Cleanny Property Services Ltd at the Client’s request, whether experimental or otherwise, will be billed accordingly.
3.2. Invoice payments are due within the stipulated dates mentioned on the invoice through RBS, our designated bank.
3.3. Overdue accounts may incur interest charges at a rate of 8.5%. In cases of non-payment, Cleanny Property Services Ltd reserves the right to withhold services, documents, and information, as well as the right to cease working on the Client’s account and terminate the engagement.
3.4. Expenses incurred while acting on behalf of the Client will be billed, with detailed records available for inspection. Such expenses may include meeting room usage, internal printing, courier charges, and international but not national telephone calls.
3.5. Persistent late payments will necessitate a 20% pre-payment for all subsequent work.
3.6. Cleanny Property Services Ltd possesses statutory rights to interest and compensation for debt recovery under the late payment legislation if payments are not made in accordance with agreed credit terms.
3.7. Unless expressly stated otherwise, all prices are denominated in Pounds Sterling and exclude VAT and other applicable duties.
3.8. Invoicing will occur on a monthly basis or upon project completion, in line with the agreed-upon terms.
3.9. All prices are considered net, with no settlement discount offered. Payment for all accounts is due no later than 7 (seven) days from the invoice date unless an alternative arrangement has been mutually agreed upon in writing by Cleanny Property Services Ltd.
3.10. After the expiry of the 7-day payment period, all ongoing work for The Client will be suspended.
3.11. Any quotations provided by Cleanny Property Services Ltd remain valid for 30 (thirty) days. After this period, Cleanny Property Services Ltd reserves the right to revise the quotation.
3.12. Cleanny Property Services Ltd offers services on both a one-off and retainer basis.
3.13. Any additional work requested beyond the original scope will be quoted separately and added to the initial invoice. To discontinue the service, one month’s notice is required.
3.14. Cleanny Property Services Ltd reviews all cleaning service prices annually, adjusting them in line with inflation, minimum wage increases, or other reasonable circumstances.
4.1. Cleaning materials are supplied by Cleanny Property Services Ltd. If the Client wishes to provide their own solutions or equipment, these must be safe to use and operate, fully functional, and require no special skills for cleaning purposes.
4.2. If the Client’s equipment is complex to operate, they must furnish the Cleaner with clear and comprehensive instructions.
4.3. Should the Client require the Cleaner to use their materials and equipment, including a vacuum cleaner, Cleanny Property Services Ltd cannot be held liable for any issues that may arise, whether related to the equipment itself or the outcome of its use.
5.1. Cleanny Property Services Ltd will furnish the Client with a checklist upon request or request the Client to provide a list of cleaning priorities. This allows the Cleaner to systematically complete tasks within the allocated time.
6.1. Cleanny Property Services Ltd does not entertain refund claims once a cleaning service has been performed. In the event of dissatisfaction, the Client must notify Cleanny Property Services Ltd within 24 hours, and corrective action will be taken.
6.2. Refunds will be issued solely if the Client has canceled a cleaning visit within the approved time frame (24 hours) prior to the scheduled cleaning session, and payment has already been received by Cleanny Property Services Ltd.
6.3. Refunds will be processed in cases where a Cleaner fails to attend a scheduled cleaning visit for which payment has already been received by Cleanny Property Services Ltd.
7.1. The Client is liable to pay the full price of the cleaning visit if:
a) The Client cancels or changes the date/time less than 24 hours prior to the scheduled appointment;
b) The Client fails to provide access to the service premises, preventing Cleanny Property Services Ltd from completing the booked work;
c) There is an issue with the Client’s keys, and the Cleaner cannot gain access. If keys are provided, they must open all locks without any special efforts or skills.
7.2. If the Client needs to alter a cleaning day or time, Cleanny Property Services Ltd will make efforts to accommodate the change. A minimum of 24 hours’ notice is required. However, Cleanny Property Services Ltd cannot guarantee the availability of the same operative on the new day and time, as changes are subject to availability.
7.3. Cleanny Property Services Ltd’s cleaning operatives work on any day of the week, including Bank Holidays. If the Client’s cleaning visit is scheduled on a Bank Holiday and the Client fails to cancel the visit 24 hours prior to the start of the cleaning session, the regular amount for that cleaning visit will be charged, irrespective of whether the cleaning operative has completed the work.
8.1. The Client may terminate this contract by providing 30 days’ written notice after the initial contracted term of 12 months has ended.
8.2. If the Client wishes to terminate the contract within the initial 12-month term, the Client must settle the outstanding balance for the remaining contract period.
8.3. A cancellation fee equivalent to 30 days’ service will be charged if:
- No notice is given;
- The Client provides a termination notice of fewer than 30 days.
- 8.4. Before terminating the Contract, the Client must provide details of any incoming contractor for compliance with the Transfer of Undertaking (Protection of Employment) Regulations 2006.
9.1. Cleanny Property Services Ltd’s public liability insurance covers damages caused by a cleaning operative up to £1,000,000.00. Claims are subject to an excess of £100.00 payable by the client to maintain competitive pricing.
9.2. The Client agrees that, due to the nature of the service, Cleanny Property Services Ltd guarantees to rectify any reported problems within 24 hours. For claims arising on a Saturday, they must be reported by Monday 12:00 to be considered valid. Cleanny Property Services Ltd may require entry to the location within 24 hours to correct the issue. Refunds or adjustments must be requested directly from Cleanny Property Services Ltd and are subject to approval.
9.3. The Client forfeits the right to stop payment unless Cleanny Property Services Ltd fails to fulfill the guarantee as outlined in part 15.
9.4. While the Cleaners take precautions to avoid breakages, accidents may occur. Identical replacement is attempted but not guaranteed. For this reason, Cleanny Property Services Ltd advises storing irreplaceable items away from cleaning operatives.
9.5. In the case of damage, Cleanny Property Services Ltd will repair the item at its cost. If the item cannot be repaired, Cleanny Property Services Ltd will credit the customer with the item’s actual cash value towards a replacement from a Company-approved source upon payment of cleaning services rendered.
9.6. Cleanny Property Services Ltd is not responsible for damage due to faulty or improper installation. All surfaces (e.g., marble, granite) are assumed sealed and ready to clean without causing harm.
9.7. Attempted insurance fraud or the use of false information for fraudulent purposes will be prosecuted by Cleanny Property Services Ltd and the Insurance Provider(s), incurring monetary compensation and legal fees.
9.8. Key replacement/locksmith fees are only covered if keys are lost by our operatives, with a £30 per location liability limit.
10.1. Cleanny Property Services Ltd takes all complaints seriously. If dissatisfied with any aspect of the service, the Client is encouraged to call as soon as possible to allow rectification. Customer satisfaction is a priority.
11.1. Cleanny Property Services Ltd shall not be liable under any circumstances for any loss, expense, damage, delay, costs, or compensation (direct, indirect, or consequential) arising from or connected with the late arrival of Company operatives at the service address. Cleanny Property Services Ltd endeavors to be punctual, but unforeseen transport and other issues beyond control may cause delays or necessitate rescheduling.
11.2. Cleanny Property Services Ltd shall not be liable under any circumstances for any loss, expense, damage, delay, costs, or compensation (direct, indirect, or consequential) arising from or connected with:
- A cleaning job not completed due to a lack of hot water or electricity.
- Third parties entering or present at the Client’s premises during the cleaning process.
- 11.3. Any existing damage to the Client’s property in the form of old stains/burns/spillages etc., which cannot be cleaned/removed completely by the cleaning operative. Any damages worth £100.00 or less.
12. Supplementary Terms
12.1. If the Client requests Cleanny Property Services Ltd to collect keys from a third party’s address, a £5.00 charge will apply, covering only the pickup of keys. An additional £5.00 charge will apply if these keys need to be returned to the third party’s address or any other location.
12.2. Cleanny Property Services Ltd reserves the right to re-evaluate rates if the Client’s initial task list changes.
12.3. Cleanny Property Services Ltd retains the right to amend the initial quotation if the Client’s original requirements change.
12.4. Estimates for task duration are provided based on the average time to clean a property of similar size. However, the actual time may vary, especially for one-off cleans, due to longer intervals between cleaning sessions, different cleaning tasks, and property conditions.
12.5. The Client acknowledges that quoted prices may vary based on the property’s condition and room sizes.
12.6. Cleanny Property Services Ltd will endeavor to arrange a replacement cleaner if the regular cleaner cannot attend a scheduled visit and will inform the Client in advance.
12.7. Post Construction Cleaning, Event Cleaning, or neglected homes may take up to three times longer than a well-maintained home. Cleanny Property Services Ltd recommends specialized cleaning services for such scenarios.
12.8. Cleaning operatives are not authorized to hand wash any Client’s clothing items; only a washing machine can be used.
12.9. Fragile and highly breakable items must be secured or removed during the cleaning process.
12.10. Cleanny Property Services Ltd reserves the right to make reasonable changes to the Terms and Conditions in agreement with the other party.
13. Our Guarantee
13.1. Cleanny Property Services Ltd has built its business and reputation by providing clients with the best possible cleaning service. Still, Cleanny Property Services Ltd acknowledges that human errors may occur. Therefore, Cleanny Property Services Ltd offers a guarantee. If the Client is not satisfied with any areas that have been cleaned, Cleanny Property Services Ltd’s operative will return to the Client’s premises and re-clean those areas free of charge.
These Terms and Conditions represent a comprehensive agreement between Cleanny Property Services Ltd and The Client. Any use of Cleanny Property Services Ltd’s services indicates acceptance of these terms.
